Terms & Conditions

Provided by Creative Treasury Pty Ltd (ABN: 41 648 801 003).

These Terms and Conditions (“Terms”) govern the provision of live music performance services (“Services”) supplied by Creative Treasury Pty Ltd (“the Company”). The Company delivers these Services under the brand, “Live Music by Rachel O’Brien,” which refers to the Company’s live music offering and may include performances by Rachel O’Brien and/or other contracted artists (“the Artist(s)”), as agreed with the Client in advance.

By confirming a booking, the Client acknowledges and agrees to be bound by these Terms.

1.      Bookings & Payment

1.1.     Booking Confirmation
A booking is considered confirmed only when:

  • the Client has accepted a written quote or proposal; and

  • the required deposit has been received in full by the Company.

1.2.    Deposits

  • One-time events: A non-refundable 20% deposit to secure the date.

  • Residencies: A deposit equal to the one (1) month’s fee is required. 20% of the first month amount is non-refundable.

1.3.    Payment Schedule

  • Remaining balance is due no later than 14 days before the event or first performance date, unless otherwise agreed in writing.

  • For ongoing residencies, payments may be made monthly or upfront, as agreed.

1.4.    Payment Method
All payments must be maid via bank transfer to the Company’s nominated account.

1.5.    Validity of Quotes
Quotes are value for 14 days from the date of issue. Rates may change after this period.

1.6.    Public Holiday Surcharges

  • 25% surcharge applies to all public holiday performances.

  • 100% surcharge applies to performances on Christmas Day and Christmas Eve.

2.     Style, Repertoire & Artistic Direction

2.1.     Repertoire
The Artist will curate a set list appropriate to the event style and mood. The Client may request a sample repertoire list in advance.

2.2.   Song Requests
The Artist will accept up to three (3) specific song requests with a minimum of four (4) weeks’ notice (six (6) weeks’ notice for peak periods between November and December). Requests are subject to feasibility.

2.3.   Artistic Discretion
The Artist retains discretion regarding performance style, pacing, and song choices during the event to ensure a high-quality performance.

2.4.   Dress Code
The Artist will comply with reasonable dress code requirements when communicated at the time of booking.

3.     Performance Requirements

3.1.     Client To Provide
Unless otherwise agreed, the Client must ensure:

  • One (1) reliable power outlet (unless alternative arrangements have been agreed).

  • One (1) stool or suitable seating option.

  • A performance area that is:

  • Shaded and protected from sun, rain, and wind.

  • Safe, stable, and free from interference by guests (particularly children).

  • Large enough for equipment setup and safe movement.

3.2.    Equipment Provided by the Artist
The Artist(s) typically provide:

  • musical instruments;

  • microphones and stands;

  • compact sound system (e.g. Bose L1 Pro8 or similar).

For large venues, the Client may be required to hire external AV equipment at their own expense.

3.3.   Sound System Usage
Use of the Artist’s sound system for speeches or announcements must be arranged in advance and may incur an additional fee. The microphone is not wireless.

3.4.   Battery-Powered Equipment
If the venue has no access to power, the Company can arrange suitable battery-powered equipment for an additional fee.

3.5.    Meals & Refreshments
The Client must provide:

  • A meal for performances outside Perth, or for any 3+ hour performance within Perth.

  • Light refreshments (e.g. water or tea) for all performances.

4.     Travel, Accommodation & Destination Events

4.1.     Travel Costs
Performances outside Perth may incur additional charges, including but not limited to:

  • travel time;

  • accommodation;

  • flights or fuel;

  • per-diem allowances.

These will be itemised in the booking quote.

4.2.   Regional, Interstate, or International Events
For performances outside the Perth metropolitan area, the Company will ordinarily arrange all required travel and accommodation for the Artist(s), including flights, transport, and lodging. These costs will be itemised and reimbursed by the Client as part of the booking. Where it is more practical or cost-effective for the Client to arrange certain travel elements (such as accommodation, local transfers, or in-house corporate travel bookings), the Client may do so by prior written agreement with the Company.

5.     Residencies

5.1.    Trial Residencies
Clients may commence a one-month live music residency trial before entering a longer-term arrangement.

5.2.   Residency Durations

  • Outside Perth: minimum 3-day “Regional Weekender” booking.

  • Perth metropolitan: 1-month, 3-month, or ongoing month-to-month residency.

5.3.   Residency Cancellations
Ongoing residencies may be cancelled or paused within four (4) weeks’ written notice. Deposits and any prepaid travel expenses are non-refundable.

6.     Cancellations, Reschedules & Refunds

6.1.    Deposit
All deposits are non-refundable and non-transferable to new dates.

6.2.   Refund Schedule (One-Time Events)
Refunds apply to amounts paid beyond the deposit and exclude travel costs already incurred.

  • Cancelled 4+ weeks before event: 80% refund.

  • Cancelled 2–4 weeks before event: 50% refund.

  • Cancelled under 14 days before event: no refund.

6.3.   Rescheduling
The Company will make reasonable efforts to accommodate rescheduled dates, subject to availability.

7.      Force Majeure

If the Artist(s) or Client is unable to proceed with a performance due to illness, extreme weather, government restrictions, natural disasters, or other force majeure events:

  • Both parties agree to act in good faith to reschedule or cancel the event.

  • Deposits may be transferred to a new date at the Company’s sole discretion.

Neither party will be liable for consequential losses arising from force majeure events.

8.     Recording, Media & Use of Content

8.1.    Client Recording
The Client may take photos and videos for personal or social media use, provided the content does not misrepresent the Artist(s) or the performance.

8.2.   Professional Recording
Any professional recording (audio or video) requires written consent from the Company. Additional licensing fees may apply.

8.3.   Company Use of Media
The Company may record portions of the performance for promotional purposes unless the Client objects in writing prior to the event.

9.     Health, Safety & Conduct

9.1.    Venue Safety
The Client warrants that the venue is structurally sound, legally compliant, and safe for electrical and performance use.

9.2.   Behaviour of Guests
The Client is responsible for ensuring guests do not interfere with the Artist(s), equipment, stage area, or performance.

9.3.   Breaks
Typical performance structure is 40–50 minutes on, 10–20 minutes break. The Artist(s) provides curated playlists for breaks unless otherwise agreed.

10.   Insurance & Liability

10.1.  Company Insurance
The Company maintains appropriate insurance for its own Artists and equipment.

10.2. Client Insurance
The Client is responsible for ensuring the event venue has adequate public liability insurance.

10.3. Limitations of Liability
The Company and Artist(s) are not liable for:

  • loss or damage caused by venue conditions, third-party vendors, or guest interference;

  • indirect or consequential losses.

To the extent permitted by law, liability is limited to the amount paid by the Client for the specific booking.

11.    Equipment Damage

The Client is responsible for all costs associated with damage to the Artist’s equipment caused by guests, weather exposure (contrary to instructions), or unsafe venue conditions.

12.   Intellectual Property

All repertoire choices, arrangements, and musical content remain the Artist’s intellectual property. The Client receives no right to reproduce or distribute the performance without written permission. 

13.   Confidentiality

All pricing, proposals, and agreements between the Client and Company are confidential and may not be disclosed to third parties except where legally required.

 14.   Governing Law

These Terms are governed by the laws of Western Australia. Any disputes will be resolved through good-faith negotiation; failing that, parties may pursue remedies available under WA law.

15.   Amendments

The Company may amend these Terms from time to time. The version in effect at the time of booking acceptance will apply to that booking.
